These Terms of Service ("Terms") form a binding agreement ("Agreement") between you ("User," "You") and Halo Fuel Services LLC, an Arizona limited liability company ("Halo," "we," "us," or "our").
By accessing or using Halo's website, mobile booking application, or delivery service (collectively, the "Service"), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, please do not use the Service.
Halo provides on-demand mobile delivery of gasoline directly to a customer's vehicle at a specified location within our service area (currently a 20-mile radius of Scottsdale, Arizona). Orders are placed exclusively through our website or mobile application; we do not accept phone orders. Minimum order size is 10 gallons per delivery.
Halo reserves the right to modify, suspend, or discontinue any part of the Service — including service area, pricing, hours of operation, or minimum order requirements — at any time. Material changes will be reflected on our website and, where applicable, communicated to active subscribers.
You must be at least 18 years old and legally able to enter into this Agreement to use the Service. When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@halofuelservices.com if you suspect unauthorized use of your account.

Message and data rates may apply. Message frequency varies based on your order activity. You may opt out at any time by replying STOP to any message; reply HELP for assistance, or contact us at info@halofuelservices.com or (602) 370-4958. Wireless carriers are not liable for delayed or undelivered messages. We do not sell or share your mobile information with third parties for their marketing purposes.
The Service relies on third-party providers (including but not limited to Stripe for payments, Twilio for SMS, and Calendly for scheduling). Your use of any third-party service accessed through Halo is subject to that provider's own terms and privacy policy. Halo is not responsible for the acts, omissions, or performance of third-party providers.
All content associated with the Service — including the Halo name, logo, branding, website, and app design — is the property of Halo Fuel Services LLC and is protected by applicable intellectual property laws. You may not copy, modify, reverse-engineer, scrape, or create derivative works from the Service without our prior written consent.
The Service is provided on an "as is" and "as available" basis. While Halo takes reasonable care in the handling, transport, and delivery of fuel, we make no warranty that the Service will be uninterrupted, error-free, or available at all times or in all locations.
To the fullest extent permitted by Arizona law, Halo's total liability arising out of or relating to the Service — under any theory of liability — is limited to the amount you paid for the specific delivery giving rise to the claim. Halo is not liable for indirect, incidental, or consequential damages arising from use of the Service.
Nothing in this Agreement limits or waives Halo's liability for gross negligence, willful misconduct, or personal injury or property damage caused by Halo's negligence, to the extent such limitation is prohibited by Arizona law.
You agree to use the Service only for its intended purpose and to provide accurate information about your vehicle and delivery location, as inaccurate information provided by you may affect delivery safety.
You agree to indemnify and hold Halo harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, violation of these Terms, or violation of any law or third-party right.
This Agreement is governed by the laws of the State of Arizona, without regard to its conflict-of-law principles.

You and Halo agree to resolve any dispute arising from these Terms or your use of the Service through binding, individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for misuse of intellectual property.
If you do not wish to be bound by this arbitration agreement, you may opt out by notifying us in writing at info@halofuelservices.com within 30 days of first accepting these Terms.
Halo may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or create a safety risk to our drivers or others.
We may update these Terms from time to time to reflect changes in our service, locations, or legal requirements. We will post the updated Terms with a new effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
